Terms and conditions
1. DEFINITION AND OBJECT OF THE CONTRACT
1.1. This contract ("Contract") is a distance contract pursuant to art. 45 and ss. of Legislative Decree 6 September 2005, n. 206 ("Consumer Code") in the case of consumer customers pursuant to art. 3 of the Consumer Code or, otherwise, a sales contract pursuant to art. 1470 and ss. c.c.
With the term '' consumer '', according to the relative definition referred to in Article 3 of Legislative Decree no. 206/2005, means the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.
The Contract concerns the sale of movable property between Emanuela Caruso Capri s.r.l., hereinafter referred to simply as Emanuela Caruso Capri, with registered office in Casoria (NA) and the Customer.
The Contract is concluded directly through the acceptance by Emanuela Caruso Capri of a purchase proposal issued by the Customer through the website www.emanuelacaruso.com, on the basis of the methods described in the following art. 3.
2. PRICES
2.1. The prices of the products illustrated on the website www.emanuelacaruso.com are indicated in Euros and include VAT, the RAEE Eco Contribution pursuant to Legislative Decree no. 49 of 14 March 2014 and all other taxes. Delivery costs are indicated on the website www.emanuelacaruso.com. The price payable by the Customer is the one in effect at the conclusion of the contract.
2.2. If an incorrect price has been advertised, Emanuela Caruso Capri will contact the customer to check whether they intend to proceed with the purchase of the product at the correct price. If the Customer does not intend to proceed with the purchase, or Emanuela Caruso Capri is unable to contact him, Emanuela Caruso Capri will cancel the order. Emanuela Caruso Capri is not obliged to sell the product at the wrong price if the error was known by the Customer according to ordinary diligence. 3. METHOD OF PURCHASE AND PAYMENT
3.1. The contract will be finalized through the following phases:
By sending the order, the Customer will send Emanuela Caruso Capri a proposal to purchase the selected product or products. Emanuela Caruso Capri will send the Customer the order confirmation where all the data relating to the purchase will be indicated, that is: the products requested with information relating to their essential characteristics, product prices, shipping costs and applicable taxes as well as the link reference of the contractual conditions. There will also be a summary of the general conditions applicable to the contract including an indication of withdrawal.
The contracts are concluded between the parties when the Customers receive the order confirmation from Emanuela Caruso Capri.
If the purchase proposal is made by the customer by telephone, the contract will be concluded at the time of delivery of the product by Emanuela Caruso Capri.
Emanuela Caruso Capri declines all responsibility and any right of the Customer to compensation for damages and / or compensation for the failure and / or incorrect and / or incomplete receipt of the order confirmation due to causes not attributable to Emanuela Caruso Capri but certain is excluded. , by way of example, due to negligence of the Customer or deficiencies in the telematic tools used by the Customer.
Customers are advised to pay particular attention to reporting the data relating to the delivery address.
Emanuela Caruso Capri declines all responsibility and any right of the Customer to compensation for damages or indemnity is excluded in relation to missed or delayed deliveries caused by errors, inaccuracies or deficiencies regarding the address of the place of delivery as indicated by the Customer in the order.
Emanuela Caruso Capri declines all responsibility and any right of the Customer to compensation for damages or indemnity is excluded in relation to incorrect or missing communications caused by the incorrect indication of the email address given by the Customer in the order.
Emanuela Caruso Capri may, at its sole discretion and without any liability to the Customer, refuse the purchase proposal received from the Customer. Emanuela Caruso Capri reserves the right not to process purchase orders or registrations that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products. If the customer intends to purchase products that are no longer available, Emanuela Caruso Capri will inform the customer. The customer can wait for any availability or cancel the order.
3.2. The Customer may pay by (a) PayPal or credit cards; (b) bank transfer; (c) cash on delivery. In case of payment by PayPal or credit card, Emanuela Caruso Capri will ship the products only after receiving the payment authorization and, failing that, will not proceed with the shipment. In case of payment by bank transfer, Emanuela Caruso Capri will ship the products only after having received the transfer. In case of payment by cash on delivery, Emanuela Caruso Capri will normally ship the products within 2 working days of placing the order. Payments by check are not accepted.

4. DELIVERY OF PRODUCTS
4.1. Emanuela Caruso Capri delivers the products throughout the Italian territory, including San Marino and the Vatican City. Further information is available by contacting Emanuela Caruso Capri or on the website www.emanuelacaruso.com Shipping Section. Emanuela Caruso Capri generally delivers EXCLUSIVE PRODUCTS normally within 2-3 working days (weekdays, Saturdays and Sundays excluded) from receipt of payment (in case of payment by PayPal / credit card or bank transfer) or from placing the order (in case of cash on delivery). Same timing and conditions also in the month of August
For all other categories on the website, Emanuela Caruso Capri needs about 15 woring days from receipt of payment. There could be an additional delay on the delivery time for these products, because they are made specifically for the customers and some materials could not be available at the moment of the order.
Furthermore, purchases made from 25/07 will have delivery in the first 10 days of September.
4.2. The products covered by a single order cannot be delivered to different addresses and paid for with different payment methods. Emanuela Caruso Capri delivers to the address provided by the Customer at the time of placing the order.
4.3. The risk of loss or damage to the products is transferred to the Customer when the latter, after delivery, materially takes possession of the goods.
5. WARRANTIES AND ASSISTANCE
5.1. The products purchased by the Customer are subject to the rules on guarantees and assistance for the sale provided for by the Civil Code or the Consumer Code. In particular, if the products have a guarantee recognized by the manufacturer of the same (commercial / conventional guarantee), any defects / discrepancies of the products must be reported by the Customers directly to the manufacturer according to the methods and terms indicated in the guarantee itself. "Consumer" Customers are recognized the rights of the Consumer pursuant to art. 130 of Legislative Decree 206/05; these rights must be exercised under the terms of art. 132 of the same Legislative Decree 206/05. Therefore, if the Consumer finds flaws and defects in the products purchased, he can contact Emanuela Caruso Capri under penalty of forfeiture within 2 (two) months of discovery and request the repair of the good or the replacement of the product unless the requested remedy is objectively impossible or excessively. onerous compared to the other.
Where the requested remedy proves impossible or excessively burdensome, or has caused significant inconvenience to the Customer himself, the latter may request an appropriate price reduction or termination of the contract at his choice. In any case, the termination of the contract for minor defects, with respect to which it has not been possible or is excessively burdensome, to proceed with the replacement of the relative products will not be allowed.
6. OBLIGATIONS OF THE CUSTOMER
6.1. The Customer declares and guarantees: (i) to be of age; (ii) that the data provided by the same for the execution of the Contract are correct and truthful
7. CONSUMER'S RIGHT OF WITHDRAWAL
7.1. The exercise of the right of withdrawal is excluded in the cases referred to in Article 59 of Legislative Decree 206/2005 and subsequent amendments.
By way of non-exhaustive example, the following hypotheses are reported in which the right of withdrawal is excluded: supply of tailor-made products, clearly personalized and products for the customer on commission.
The products purchased on the site are not pre-packaged or available in stock, but each item is put into production at the time of the customer's order, exclusively for the customer.
8. GENERAL CLAUSES
8.1. Emanuela Caruso Capri may transfer all or part of the rights and obligations deriving from this Agreement to third parties.
8.2. Emanuela Caruso Capri reserves the right to modify these General Conditions, without prior notice and without any prejudice to sales made prior to such modifications. Any changes will be effective from the date on which they will be communicated to the public and will apply to sales made after that date. The latest updated version of the General Conditions is the one available on the website www.emanuelacaruso.com.
8.3. The Customer's personal data are processed by Emanuela Caruso Capri according to the provisions of the information on Data Processing, available on the website www.emanuelacaruso.com, Privacy Section.
8.4. This Agreement is subject to Italian law. Any matter relating to the Contracts will be subject to Italian jurisdiction. For civil disputes relating to this sales contract, the mandatory territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the State.
8.5. Pursuant to art. 14 of Regulation 524/2013, the user is informed that in the event of a dispute, he or she may submit a complaint via the ODR platform of the European Union which can be reached at the following link http://ec.europa.eu/consumers/odr/. 1. DEFINIZIONE E OGGETTO DEL CONTRATTO
1.1. Il presente contratto ("Contratto") è un contratto a distanza ai sensi degli artt. 45 e ss. del D.Lgs. 6 settembre 2005, n. 206 ("Codice del Consumo") nel caso di clienti consumatori ai sensi dell'art. 3 del Codice del Consumo ovvero, altrimenti, un contratto di vendita ai sensi degli artt. 1470 e ss. c.c.
Con il termine ''consumatore'', secondo la relativa definizione di cui all'art.3 D.Lgs n. 206/2005, si intende la persona fisica che agisce per scopi estranei all'attività imprenditoriale, commerciale, artigianale o professionale eventualmente svolta.
Il Contratto ha per oggetto la vendita di beni mobili tra Emanuela Caruso Capri s.r.l., di seguito indicata semplicemente Emanuela Caruso Capri, con sede legale in Casoria (NA) ed il Cliente.
Il Contratto è concluso direttamente attraverso l’accettazione da parte di Emanuela Caruso Capri di una proposta di acquisto emessa da parte del Cliente tramite il sito web www.emanuelacaruso.com, sulla base delle modalità descritte al successivo art. 3.
2. PREZZI
2.1. I prezzi dei prodotti illustrati sul sito web www.emanuelacaruso.com sono indicati in Euro e sono comprensivi di I.V.A., dell'Eco Contributo RAEE ai sensi del Decreto Legislativo n. 49 del 14 marzo 2014 e di ogni altra imposta. Le spese di consegna sono indicate sul sito web www.emanuelacaruso.com. Il prezzo dovuto dal Cliente è quello in vigore alla conclusione del contratto.
2.2. Qualora sia stato pubblicizzato un prezzo errato, Emanuela Caruso Capri contatterà il Cliente per verificare se intenda comunque procedere all’acquisto del prodotto al prezzo corretto. Qualora il Cliente non intenda procedere all’acquisto, ovvero Emanuela Caruso Capri non riesca a contattarlo, Emanuela Caruso Capri cancellerà l’ordine. Emanuela Caruso Capri non è obbligata a vendere il prodotto al prezzo errato qualora l’errore fosse conoscibile dal Cliente secondo l’ordinaria diligenza. 3. MODALITA' DI ACQUISTO E DI PAGAMENTO
3.1. Il contratto si perfezionerà attraverso le seguenti fasi:
Con l’invio dell’ordine il Cliente trasmetterà a Emanuela Caruso Capri una proposta di acquisto del prodotto o dei prodotti selezionati. Emanuela Caruso Capri invierà al Cliente la conferma d’ordine ove saranno indicati tutti i dati relativi all’acquisto ovvero: i prodotti richiesti con le informazioni relative alle loro caratteristiche essenziali, i prezzi dei prodotti, le spese di spedizione e i tributi applicabili nonché il link di riferimento delle condizioni contrattuali. Vi sarà, inoltre, un riepilogo delle condizioni generali applicabili al contratto ivi compresa l'indicazione del recesso.
I contratti si intendono conclusi tra le parti nel momento in cui i Clienti ricevono la conferma d’ordine da parte di Emanuela Caruso Capri.
Qualora la proposta d’acquisto sia formulata dal Cliente per via telefonica, il perfezionamento del contratto avverrà al momento della consegna del prodotto da parte di Emanuela Caruso Capri.
Emanuela Caruso Capri declina ogni responsabilità e viene escluso ogni diritto del Cliente al risarcimento di danni e/o indennizzo in ordine alla mancata e/o errata e/o incompleta ricezione della conferma d’ordine dovuta a cause non riconducibili a Emanuela Caruso Capri ma determinate, a titolo esemplificativo, da negligenza del Cliente o da carenze degli strumenti telematici in uso al Cliente.
Si raccomanda ai Clienti di porre particolare attenzione nel riportare i dati relativi all’indirizzo di recapito.
Emanuela Caruso Capri declina ogni responsabilità e viene escluso ogni diritto del Cliente a un risarcimento danni o indennizzo in ordine a mancate o ritardate consegne determinate da errori, inesattezze o carenze riguardanti l’indirizzo del luogo di recapito così come indicato dal Cliente nell’ordine.
Emanuela Caruso Capri declina ogni responsabilità e viene escluso ogni diritto del Cliente a un risarcimento danni o indennizzo in ordine ad errate o mancate comunicazioni determinate dall’errata indicazione dell’indirizzo mail riportato dal Cliente nell’ordine..
Emanuela Caruso Capri potrà, a suo insindacabile giudizio e senza alcuna responsabilità verso il Cliente, rifiutare la proposta d’acquisto ricevuta dal Cliente. Emanuela Caruso Capri si riserva la facoltà di non dar corso agli ordini d’acquisto o a iscrizioni che non diano sufficienti garanzie di solvibilità o che risultino incompleti o non corretti ovvero in caso di indisponibilità dei prodotti. Qualora il Cliente intenda acquistare prodotti non più disponibili, Emanuela Caruso Capri ne informerà il Cliente. Il Cliente potrà attendere l’eventuale disponibilità o cancellare l’ordine.
3.2. Il Cliente potrà pagare a mezzo (a) PayPal o carte di credito; (b )bonifico bancario; (c) contrassegno. In caso di pagamento a mezzo PayPal o carta di credito, Emanuela Caruso Capri spedirà i prodotti solo dopo aver ricevuto l’autorizzazione del pagamento e, in mancanza, non procederà alla spedizione. In caso di pagamento tramite bonifico bancario, Emanuela Caruso Capri spedirà i prodotti solo dopo aver ricevuto il bonifico medesimo. In caso di pagamento tramite contrassegno, Emanuela Caruso Capri normalmente spedirà i prodotti entro 2 giorni feriali dall’effettuazione dell’ordine. Non si accettano pagamenti tramite assegno.

4. CONSEGNA DEI PRODOTTI
4.1. Emanuela Caruso Capri consegna i prodotti in tutto il territorio italiano, compreso San Marino e Città del Vaticano. Ulteriori informazioni sono disponibili contattando Emanuela Caruso Capri o sul sito internet www.emanuelacaruso.com Sezione Spedizioni. Emanuela Caruso Capri consegna I PRODOTTI EXCLUSIVE ,generalmente entro 2-3 giorni lavorativi (giorni feriali, sabato e domenica esclusi) dalla ricezione del pagamento (in caso di pagamento con PayPal/carta di credito o bonifico bancario) o dalle’effettuazione dell’ordine (in caso di pagamento alla consegna).
Stesse tempistiche e condizioni anche nel mese di Agosto.
Per tutte le altre categorie in evidenza sulla piattaforma, Emanuela Caruso Capri necessita all'incirca di 15 giorni lavorativi dal momento del pagamento, riservandosi la possibilta' di estendere tale tempistica oltre le due settimane , in considerazione del fatto che ogni modello è prodotto per il cliente al momento e ci potrebbe essere la necessita' di approvigionamento di pietre e altri materiali non disponibili a magazzino.
Inoltre gli acquisti effettuati dal 25/07 avranno consegna nei primi 10 giorni di settembre.
4.2. I prodotti oggetto di un unico ordine non possono essere consegnati presso indirizzi diversi e pagati con metodi di pagamento diversi. Emanuela Caruso Capri consegna all’indirizzo fornito dal Cliente al momento dell’effettuazione dell’ordine.
4.3. Il rischio della perdita o del danneggiamento dei prodotti si trasferisce al Cliente nel momento in cui quest’ultimo, effettuata la consegna, entra materialmente in possesso dei beni.
5. GARANZIE E ASSISTENZA
5.1. I prodotti acquistati dal Cliente sono soggetti alle norme in materia di garanzie e assistenza per la vendita previste dal Codice Civile o dal Codice del Consumo. In particolare qualora i prodotti presentino una garanzia riconosciuta dal produttore degli stessi (garanzia commerciale/convenzionale), eventuali vizi/difformità dei prodotti devono essere denunciati dai Clienti direttamente al produttore secondo le modalità e i termini indicati nella garanzia stessa. Ai Clienti “Consumatori” sono riconosciuti i diritti del Consumatore di cui all’art. 130 del D.Lgs 206/05; tali diritti devono essere esercitati nei termini di cui dall’art. 132 del medesimo D.Lgs 206/05. Quindi, ove il Consumatore riscontri vizi e difetti nei prodotti acquistati potrà contattare Emanuela Caruso Capri a pena di decadenza entro 2 (due) mesi dalla scoperta e richiedere la riparazione del bene o la sostituzione del prodotto salvo che il rimedio richiesto sia oggettivamente impossibile o eccessivamente oneroso rispetto all’altro.
Laddove il rimedio richiesto risulti impossibile o eccessivamente oneroso, o abbia arrecato notevoli inconvenienti al Cliente medesimo, quest'ultimo potrà richiedere a sua scelta una congrua riduzione del prezzo o la risoluzione del contratto. Non sarà, in ogni caso, ammessa la risoluzione del contratto per difetti di lieve entità, rispetto ai quali non sia stato possibile o risulti eccessivamente oneroso procedere alla sostituzione dei relativi prodotti.
6. OBBLIGHI DEL CLIENTE
6.1. Il Cliente dichiara e garantisce: (i) di essere maggiorenne; (ii) che i dati dallo stesso forniti per l'esecuzione del Contratto sono corretti e veritieri
7. DIRITTO DI RECESSO DEL CONSUMATORE
7.1. E’ escluso l’esercizio del diritto di recesso nelle ipotesi di cui all’art.59 D.Lgs. n.206/2005 e successive modificazioni.
A titolo esemplificativo e non esaustivo si indicano le seguenti ipotesi in cui è escluso il diritto di recesso: fornitura di prodotti confezionati su misura,chiaramente personalizzati e prodotti per il cliente su commissione.
I prodotti acquistati sul sito, non sono preconfezionati o disponibilita' di magazzino, ma ogni articolo viene messo in produzione al momento dell'ordine del cliente, esclusivamente per il cliente stesso.
8. CLAUSOLE GENERALI
8.1. Emanuela Caruso Capri potrà cedere a terzi tutti, o parte, i diritti e gli obblighi derivanti dal presente Contratto.
8.2. Emanuela Caruso Capri si riserva il diritto di modificare le presenti Condizioni Generali, senza alcun preavviso e senza alcun pregiudizio per le vendite effettuate precedentemente a tali modifiche. Eventuali modifiche saranno efficaci con decorrenza dalla data in cui saranno comunicate al pubblico e si applicheranno alle vendite effettuate a decorrere da detta data. L'ultima versione aggiornata delle Condizioni Generali è quella reperibile sul sito internet www.emanuelacaruso.com.
8.3. I dati personali del Cliente sono trattati da Emanuela Caruso Capri secondo quanto previsto nella informativa sul Trattamento dei Dati, disponibile sul sito internet www.emanuelacaruso.com, Sezione Privacy.
8.4. Il presente Contratto è soggetto alla legge italiana. Ogni questione relativa ai Contratti sarà soggetta alla giurisdizione italiana. Per le controversie civili inerenti il presente contratto di vendita, la competenza territoriale inderogabile è del giudice del luogo di residenza o di domicilio del consumatore, se ubicati nel territorio dello Stato.
8.5. Ai sensi dell’art. 14 del Regolamento 524/2013 si informa l’utente che in caso di controversia potrà presentare un reclamo a mezzo della piattaforma ODR dell’Unione Europea raggiungibile al seguente link http://ec.europa.eu/consumers/odr/. La piattaforma ODR costituisce un punto di accesso per gli utenti che desiderano risolvere in ambito extragiudiziale le controversie derivanti dai contratti di vendita o di servizi online.
